What is meant by Stat Holidays?

In Canada, statutory holidays are enacted by either the federal government or a provincial or territory government. You will get federal holidays instead of provincial holidays if the federal government governs your line of work. Statutory holidays are frequently referred to as “general” or “public” holidays.

Statutory Holidays List for the Ontario State

Stat Holiday Pay Eligibility

All statutory holidays must be taken off work, and employees are typically entitled to public holiday compensation. If the Ontario Employment Standards Act regulates their workplace and they follow “the first and last rule,” the majority of employees are eligible for stat holiday pay.

In order to be eligible for stat holiday pay in Ontario, an employee must either have worked their final regularly scheduled shift prior to the stat holiday and their first shift after it or have a valid excuse for missing either of those days.

It makes no difference how recently qualified individuals were hired; they can be full-time, part-time, permanent, or on a term contract. Employees are not entitled to holiday compensation if, without justifiable excuse, they do not complete their final regularly planned shift before a public holiday or their first regularly scheduled day after a public holiday.

Stat Holiday Pay Calculation

In Ontario, holiday pay is computed by multiplying the sum of the employee’s regular hourly wages for the four work weeks prior to the public holiday by 20 and the total amount of vacation pay due for those four weeks. In light of this, it is simpler to calculate the statutory holiday pay payable to workers who are given a set wage.

The premium pay, in addition to the Ontario statutory holiday pay, is available to workers who work on statutory holidays in Ontario. The formula for this is 1.5 times the usual hourly rate times the amount of hours done. A worker’s premium pay is 112 times their base salary. The employee must receive 112 times their regular pay rate for each hour worked on a public holiday for which they were paid premium time.
